FS 06-125/Ex. AFFIRMATION OF FACULTY REFERENDA ON FS 05-69/EX. - UARTP DOCUMENT - AMEND SECTION 6.06.D

The Executive Committee recommends the following motion:

The Faculty Senate affirms the results of the ballot measure calling for the rescission of FS 05-69, Ex., and requests that the President rescind the changes specified in FS 05-69, Ex.

Background: The 2005-2006 Faculty Senate voted to amend Section 6.06.D of the University ARTP Policy on February 2, 2006, which was approved by President Gonzalez on February 28, 2006. The approval of the proposed changes came about after months of considerable and substantive discussion in the Committee on Diversity and Equity (CODE), the University ARTP Committee and the Senate's Executive Committee and with input from the office of Human Resources and the University Counsel.

The first reading of FS 05-69/Ex. occurred on November 17, 2005. The motion received a second reading on December 8, 2005, at which time, the matter was tabled until the first Senate meeting of the spring semester. The questions and discussion during the first and second readings of resolution FS 05-69 (Proposed Amendment to Section 6.06.D of the UARTP Document) focused on two themes: 1) redundancies in the policy text which occurred as a result of several reformatting efforts (along with some numbering/lettering problems and 2) some of the language seemed to violate the distinction between the educational vs. compliance role of the AA/EOR as articulated in 2A. The 2005-2006 Executive Committee approved a set of changes for continuation of the 2nd reading in an effort to address the themes above. The agenda packet included a side by side comparison of the 1st and 2nd reading language.

On March 7, 2006, the Faculty Senate received notice of the intent to seek signatures of faculty to place a resolution before the faculty an initiative in accordance with Article I, Section 4.A of the Constitution of the Faculty of California State University, Sacramento. On April 3, 2006, the sufficient number of signatures to send the resolution to a vote of the faculty was received by the Senate. Balloting occurred during the time period of April 24 to May 5, 2006. The results of the ballot measure was approved by a vote of 86 (yes = rescind) to 61 (no = do not rescind). The Faculty Senate forwarded the results of the ballot measure to President Gonzalez on May 9, 2006 for his information and action. President Gonzalez responded August 31, 2006, requesting clarification from the Senate.
