USER PRIVACY

Some assessments may require Users to provide personally-identifying information to obtain access to the surveys and subsequent reports. Pfeiffer, An Imprint of John Wiley & Sons, Inc. ("Pfeiffer") recognizes the importance of protecting the information collected in the operation of the Materials and will take all reasonable steps to maintain the security, integrity and privacy of this information. Any information PFEIFFER collects will be adequate, relevant and not excessive for purposes of evaluating the Users in the context of the Materials; it will be kept accurate and up-to-date based on information provided and will be deleted when no longer needed. Except where necessary in connection with services provided by appropriate intermediaries, who will be required to comply with the confidentiality provisions of this policy, or when modified by your opt-in agreement, Pfeiffer will not disclose any personal information identifying any users to any third party, unless required by law or to enforce the Terms and Conditions of Use of the Platform and the Materials. Any information supplied by Users may be used by Pfeiffer and the creators of the Materials for research purposes to enhance and develop the Materials, and may be shared, only in the form of anonymized data, with third parties at Pfeiffer's option. If Users link to websites provided by third parties, be aware that each website will vary in terms of its privacy policies and Pfeiffer takes no responsibility for the use of information collected by others.

NEITHER THE AUTHORS OF THE MATERIALS NOR PFEIFFER, AN IMPRINT OF JOHN WILEY & SONS, INC., MAKE ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING EITHER THE FUNCTIONALITY OR THE CONTENTS. NEITHER THE AUTHORS NOR PFEIFFER ASSUME ANY RESPONSIBILITY FOR ERRORS OR OMISSIONS OR DAMAGES, INCLUDING ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. END USER LICENSE AGREEMENT
LICENSED RIGHTS

Pfeiffer, An Imprint of John Wiley & Sons, Inc. ("Pfeiffer") grants you a one-year non-exclusive, non-transferable license to access the assessments (the "Materials") available on this platform (the "Platform") and to allow access to other paid users of the assessment ("Users") under this Agreement. The Platform and the Materials are the work of authors published by Pfeiffer or other imprints and product lines of John Wiley & Sons, Inc. (the "Authors"). The Authors of each assessment are specifically referenced on the assessment. To the extent explicitly set forth in the Materials (and in no other fashion), you may download and make print copies of feedback reports generated by the Platform to share with Users and retain in your files. Except as explicitly provided above and by the Platform, you have no right to reproduce, disclose, assign, license or in any other way use or provide the Platform, the Materials, or any portion of either the Platform or the Materials, to any party other than your Users in accordance with this Agreement.

You acknowledge that the Platform is a training resource and the information generated by the Platform is not intended and should not be used to make any decisions about your workplace, business, or any other decision. You assume full responsibility for your use of the resulting information and feedback reports. You will take appropriate steps to counsel Users regarding the proper use of the Platform, will advise Pfeiffer if you believe any Users are violating this Agreement and will assist Pfeiffer as may be reasonably necessary to stop such violation and prevent any further violations.

OWNERSHIP AND COPYRIGHT

You acknowledge that all rights (including without limitation, copyrights, patents and trade secrets) in the Platform, any Pfeiffer publications and material which may be accessed from it and any documentation (including without limitation, the structure, sequence, organization, flow, logic, source code, object code and all means and forms of operation of the Platform) are the sole and exclusive property of Pfeiffer and/or its authors and other licensors, and are protected by the United States copyright laws, other applicable copyright laws, and international treaty provisions. Nothing on the Platform or in the Pfeiffer publications and materials, including but not limited to the Materials, may be downloaded, reproduced, stored in a retrieval system, modified, made available on a network, used to create derivative works, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording, scanning, or otherwise, except (i) in the United States, as permitted under Section 107 or 108 of the 1976 United States Copyright Act, or internationally, as permitted by other applicable national copyright laws, or (ii) as expressly authorized on the Platform or in the materials, or (iii) with the prior written permission of Pfeiffer. Notwithstanding the foregoing, a reasonable amount of material may be cached and stored by search engines indexing the Platform. The licenses set forth in (ii) and (iii) above may be revoked by Wiley on notice.
