Pregnant and Parenting Student Rights: FAQs for Sacramento State Students

Title IX prohibits discrimination on the basis of sex — including pregnancy, parenting and all related conditions — in education and in programs and activities that receive federal funding. If you are a pregnant or parenting student, you have the right to stay in school so you can meet your education and career goals. Below are some frequently asked questions from students in postsecondary schools regarding their Title IX rights:

How Does Title IX Apply to Pregnant or Parenting Students?

Title IX prohibits discrimination based on sex – including pregnancy, parenting, and all related conditions, such as abortion – in educational programs and activities that get federal funding. This means that Sacramento State must give all students who might be, are, or have been pregnant the same access to school programs and educational opportunities that other students have. Your professors or school administrators should not tell you that you have to drop out of your classes or academic program or change your educational plans due to your pregnancy.

The university can require a pregnant student to provide a doctor’s certification of fitness to continue in an education program or activity only if the same requirement is imposed on all other students with physical or emotional conditions requiring a doctor’s care. Pregnant students must be provided the same accommodations and support services available to other students with similar medical needs.


Do my professors have to excuse my absences due to pregnancy, childbirth, or abortion?

Sacramento State must excuse your absences due to pregnancy, childbirth, or any related conditions for as long as your doctor says it is necessary for you to be absent. This is true even if there is no leave policy for students with other conditions. Your professors must provide you a leave of absence for as long as it is deemed necessary by your medical doctor. When you return to school, you must be reinstated to the status you held before your leave.

What if my professor says their absence/makeup policy applies regardless of any medical condition?

While your professor may have a strict attendance policy, Sacramento State is bound by federal civil rights law. Title IX requires the university ensure that all faculty and staff comply with the law and do not discriminate against pregnant and parenting students. Thus, you cannot be penalized for pregnancy or related medical conditions. An individual professor’s policy is not OK if it breaks the law.

After returning from an excused absence, your professors must allow a reasonable amount of time to make up missed assignments and tests. The makeup assignments and tests must be reasonably equivalent to those missed, but need not be identical. If a professor provides specific “points” or other advantages to students based on class attendance, you must be given the opportunity to earn back the credit from classes missed due to pregnancy.

For example, if you have a doctor’s note that excuses you from class for several weeks because you were on “bed rest” before giving birth, Sacramento State has to provide you with the appropriate assignments and information to make up all of the work you would have been required to complete while you were out. For an extended absence, best practice suggests the University provide you with the work you miss regularly, so you do not fall far behind.

Does Sacramento State need to provide me with special academic services, like assistive equipment or furniture?

Title IX requires that Sacramento State provide pregnant students with any special services we provide to students with any other type of temporary disabilities. Please contact SSWD at (916) 278-6955 or for more information.

What about internships, career rotations, and other off-campus elements of my program – do I have a right to participate in those opportunities?

Yes. Sacramento State must allow you to continue participating in off-campus programs. For example, if your program provides opportunities to “work in the field,” you cannot be excluded based on your pregnancy. Your professor cannot require a doctor’s note for continued participation unless your professor requires one for all students who have a medical condition that requires treatment by a doctor. If they do ask for a note, they cannot second-guess your doctor’s decision. [PLEASE SUBMIT MEDICAL NOTES DIRECTLY TO SSWD OR THE OEO – NOT TO YOUR PROFESSOR]

Classmates and/or professors have made offensive comments to me about my pregnancy. Should I complain to Sacramento State about the offensive comments?

Title IX requires the university prevent and address sex-based harassment, including harassment based on pregnancy. If you experience this sort of treatment, you should seek help immediately. The law prohibits anyone from retaliating against you for filing a complaint or raising a concern. The University’s Non-Discrimination policy and complaint form can be found here.

I have a scholarship – can Sacramento State take it back when they find out I am pregnant?

No, Sacramento State cannot terminate or reduce athletic, merit, or need-based scholarships based on pregnancy. If you stay in school, you can keep your scholarship.

I want to take a semester off. Can I keep my student status, scholarship, etc.?

Not necessarily—it depends on the leave policy at your school. If you want to take off more time than your doctor says is medically necessary, you will need to consult your school’s non-medical leave policy.

What if I work for Sacramento State in addition to being a student? Do I have the same rights? Do I qualify for maternity leave?

Your rights as an employee are different from your rights as a student. If you work for Sacramento State, you may be eligible for family or medical leave, or may qualify for maternity leave under the school’s policy, but that may not include leave from your classes, beyond what is medically necessary.

I finished my pregnancy and/or have already graduated – is there anything I can do about the discrimination I experienced as a pregnant student?

You may still have options. Contact Sacramento State’s Title IX Coordinator at (916) 278-5770 or or the Department of Education’s Office for Civil Rights to learn more. Even if it is too late for you, you can help Sacramento State ensure that women who find themselves in your shoes do not run into the same barriers.

The CSU, through its chancellor and presidents, is committed to creating an atmosphere in which all students have the right to participate fully in CSU programs and activities free from unlawful Discrimination, Harassment and Retaliation. This policy is established in compliance with the California Equity in Higher Education Act (Education Code §66250 et seq.), Title IX of the Education Amendments of 1972, Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, and the Age Discrimination Act of 1975, among other applicable state and federal laws. Sacramento State provides reasonable accommodations for employees, including applicants for employment, with sensory, mental or physical disabilities. A reasonable accommodation is an accommodation that enables (1) applicants to apply for vacant positions or employees to perform the essential functions of their position, (2) is medically necessary, (3) and does not create an undue hardship.

Please note that the Ergonomic Evaluation Process is different than, and separate from, the ADA/FEHA Reasonable Accommodation process. Office equipment identified as necessary through the Ergonomic Evaluation process is the responsibility of the employee’s department, unless the employee has a qualifying disability and the equipment addresses the employee’s limitations. That determination will be made through the interactive process.

Mandatory DHR Compliance Training

Course: EDU Supervisor: Anti-Harassment, Discrimination, Retaliation (CA-13-H)

State law [California Government Code Section 12950.1] requires The CSU to provide two-hours of sexual harassment training to all supervisory employees every two years and to all new supervisory employees within six months of assuming a supervisory position. EDU Supervisor: Anti-Harassment, Discrimination, Retaliation (CA-13-H) satisfies this training requirement. The CSU defined supervisory employees required to take this training in HR Letter 2005-35.

Supervisors must identify, discourage, eliminate, and remedy any illegal discrimination, harassment, or retaliation that they know of or simply suspect. Carrying out this responsibility requires a thorough understanding of anti-discrimination laws and harassment itself so that supervisors can address problems effectively. Knowing the development and purpose of these laws provides a solid foundation for understanding them.

Course: EDU: Eliminate Campus Sexual Misconduct

CSU Executive Orders 1095, 1096, and 1097 and current law require all employees be provided this training within six months of hire an on an annual basis thereafter. This training meets that requirement.

This course provides practical training for identifying, reporting and preventing campus sexual violence, as well as assisting victims of sexual assault. Interactive case studies and videos provide engaging educational content that explains how to respond to known or suspected sexual violence, which includes sexual assault, dating violence, domestic violence, and stalking. Many interactions are based on real cases that teach important concepts to help create a safe campus community and create a culture that does not tolerate sexual violence. The course teaches employees valuable skills for assisting victims and survivors of sexual violence and reporting sexual violence. The course content also helps postsecondary institutions comply with the employee training requirements of Title IX and the Campus Sexual Violence Elimination Act (Campus SaVE Act).

Course: CSU: Preventing Discrimination and Harassment for Non-Supervisors

CSU Executive Orders 1095, 1096, and 1097 and current law require all employees be provided this training within six months of hire an on an annual basis thereafter. This training meets that requirement.

This course is designed to raise awareness about workplace harassment and discrimination, and to reduce or prevent incidents of misconduct. Using engaging exercises and real-world examples, the course fosters a clear understanding of anti-discrimination laws. It trains employees on inappropriate conduct so that they can apply what they learn to everyday situations.

Each course is available online via Skillport. To access the training, please log on to My Sac State and click on the Skillport link in the Employee Center. My Sac State can be found on the main Sacramento State home page at the top of the page. Once you are in Skillport, the training can be found under “View My Plan” → “Assigned Learning”
