Enacted by Congress in 1993
Purpose:
  1. To strengthen families
  2. Increase worker productivity
What FMLA allows:
Up to 12 weeks of unpaid leave for certain family medical emergencies during a 12-month period.
Employee is eligible after 12 months or 1,250 work hours
Covers employers with 50 or more employees within a 75 mile radius.

 

Measuring 12-Month Period
The twelve months can be measured in 3 ways:
  1. Fixed (example: Calendar or Fiscal Year)
  2. Forward (from date of first leave)
  3. Rolling (last 12 months)

 

Qualifying Familial Needs:
  1. birth and care for newborn
  2. placing a child in foster or adoptive care
  3. immediate family member with "serious health condition" requiring care
  4. the "serious health condition" of the employee

"Serious health condition" is defined as one of the following:

  1. any incapacitation or hospice, residential medical facility or hospital inpatient care, for any period of time;
  2. a health condition requiring health care provider treatment that lasts more than three days and includes any period of incapacity;
  3. a chronic, serious health condition that may include instances of incapacitation and requires periodic care provider visits;
  4. Multiple treatments for restoration surgery or for a condition that if untreated, likely results in a period of incapacity of three or more days.

52% of leave is taken for employee’s own sickness
26% is for birth and newborn care
22% is for other
Men Vs. Women
60% of FMLA users are women
40% of FMLA users are men
